Garaji Network Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of Garaji Network — the partner listing, discovery, and provider hub operated by Garaji Systems ("Garaji", "we", "us", or "our"), including partner.garajisystems.co.ke, the provider hub, and related onboarding flows (collectively, the "Platform").

By registering, listing your business, verifying your phone number, or otherwise using Garaji Network, you agree to these Terms and our Privacy Policy. If you do not agree, do not register or use the Platform.

If you register on behalf of a company, garage, workshop, or other organisation, you represent that you have authority to bind that entity to these Terms.

2. Registration commitment

By registering on Garaji Network, you agree to our Terms of Service and Privacy Policy, commit to comply with obligations under Kenyan law (including the Kenya Data Protection Act, 2019, consumer-protection rules, and tax requirements where relevant), and confirm that you will provide only lawful vehicle-care services and accurate content on the Platform.

You must not use Garaji Network to offer illegal services, misrepresent your business, or upload content that infringes third-party rights.

3. Who may join

• You operate or represent a legitimate vehicle-care business (e.g. garage, tyre centre, parts shop, towing, mobile mechanic, car wash, or related trade) in Kenya or another supported market.
• You are at least 18 years old and have authority to enter this agreement.
• Your business holds valid licences, permits, and insurance required for the services you offer in your jurisdiction.
• Information you provide (business name, phone, location, category) is accurate and kept up to date.

4. What Garaji Network provides

Garaji Network is a partner discovery and early-access launch programme. Depending on your city and verification status, drivers and customers may discover your listing, request quotes, or book services through Garaji products.

Listing is free at launch unless we communicate otherwise. Commission or success fees may apply when a Garaji-originated lead converts to a completed job or order, as described in your partner communications or pricing page.

We may roll out cities gradually ("early access"). Availability of consumer discovery in your area does not guarantee a minimum volume of leads.

5. Partner obligations

• Deliver services professionally, safely, and in line with applicable law and industry standards.
• Respond to leads and messages in a timely manner where the Platform enables contact.
• Keep your listing, pricing indications, and service descriptions truthful and not misleading.
• Protect customer data you receive through Garaji and use it only for the purpose of fulfilling the requested service.
• Comply with Kenya Revenue Authority (KRA) and eTIMS obligations where applicable to your business.
• Cooperate with Garaji verification, quality review, and dispute processes.

6. Prohibited conduct

• Fraud, fake listings, duplicate accounts, or impersonation of another business.
• Harassment, hate speech, or abusive content in listings or communications.
• Circumventing Garaji fees by diverting Garaji-originated customers off-platform without agreement.
• Scraping, reverse engineering, or automated access to the Platform except via documented APIs we provide.
• Uploading malware, spam, or unlawful content.
• Any activity that violates Kenyan law or these Terms.

7. Verification and badges

"Listed", "Verified by Garaji", and related badges reflect our review process at a point in time. They are not a government licence and do not replace your own regulatory compliance.

We may suspend or remove listings that fail verification, receive sustained complaints, or breach these Terms.

8. Marketing and service communications

We may send you service messages (OTP codes, lead alerts, account notices) by SMS, email, or push notification. These are necessary to operate your account.

With your registration consent, we may also send promotional emails and messages about Garaji Network launches, product updates, and partner programmes until you unsubscribe. You can opt out of promotional messages at any time via the unsubscribe link in emails or by contacting us.

9. Intellectual property

Garaji Systems owns the Garaji name, logos, Platform software, and design. You receive a limited, non-exclusive licence to use the Platform while your account is active.

You grant Garaji a licence to display your business name, location, photos, and listing content for discovery, marketing, and operation of Garaji Network.

10. Disclaimers and liability

The Platform is provided "as is" to the extent permitted by law. We do not guarantee uninterrupted service, minimum leads, or specific commercial outcomes.

Garaji is not a party to contracts between you and end customers except where we explicitly state otherwise. You are responsible for work performed, pricing, warranties, and disputes with your customers.

To the maximum extent permitted by Kenyan law, Garaji Systems shall not be liable for indirect, incidental, or consequential damages arising from your use of Garaji Network. Our aggregate liability for direct damages shall not exceed the fees you paid to Garaji in the twelve months before the claim, or KES 10,000 if no fees were paid.

11. Suspension and termination

You may stop using Garaji Network at any time. We may suspend or terminate access if you breach these Terms, pose a risk to users, or as required by law.

Sections that by nature should survive (liability limits, governing law, data handling) survive termination.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Kenya. Courts in Nairobi, Kenya shall have exclusive jurisdiction over disputes arising from Garaji Network, subject to mandatory consumer protections that apply to you under Kenyan law.

13. Changes to these Terms

We may update these Terms from time to time. We will post the revised version with a new "Last updated" date. Material changes may be notified by email or in-app notice. Continued use after changes take effect constitutes acceptance.
